Chapter 1: General Provisions
Article 1 (Purpose)
1. These Terms of Service (“Terms”) govern the conditions and procedures for using the web services operated by the Korea Creative Content Agency (“KOCCA”).
2. By registering, you confirm that you have read and understood these Terms. They apply to all users of KOCCA’s online services, and it is your responsibility to review and follow them.
Article 2 (Notice and Effectiveness of Terms)
1. These Terms become effective upon being posted on the website or otherwise made available to users.
2. KOCCA may revise these Terms at any time. Revised Terms will become effective upon posting in the same manner.
3. By registering for the service, you agree to be bound by the most current version of these Terms. You may not object to changes on the grounds of not having received prior notice.
Article 3 (Governing Law and Supplementary Rules)
Any matters not specified herein shall be governed by relevant laws and regulations, including but not limited to the Framework Act on Telecommunications, the Telecommunications Business Act, the Framework Act on Electronic Commerce, the Electronic Signature Act, and the Act on the Consumer Protection in Electronic Commerce.
Article 4 (Definitions)
1. Member: A person who enters into a service agreement with KOCCA to use its web services.
2. ID: The email address submitted during registration and used to identify the user.
3. Password: A combination of characters chosen by the user to secure their account.
4. Withdrawal: The act of terminating the service agreement by the user.
Chapter 2: Service Agreement
Article 1 (Establishment of Service Agreement)
1. By clicking “Agree” during the registration process, you accept these Terms.
2. The agreement becomes effective once your registration is completed and submitted.
3. Applicants must provide all requested personal information.
4. Each individual may register for only one account (ID).
Article 2 (Application for Use)
All applications must be submitted through KOCCA’s designated online form.
Article 3 (Approval of Application)
KOCCA will approve applications that meet all specified requirements.
Article 4 (Rejection of Application)
1. KOCCA may reject or delete applications—without prior notice—for the following reasons:
- Use of someone else’s identity
- False or incomplete information
- Intent to harm public order or morality
- Applicant is listed as a credit delinquent under law
- Other reasons deemed ineligible by KOCCA
2. KOCCA may delay approval if:
- System resources are insufficient
- Technical issues arise
- KOCCA deems deferral necessary
3. If an application is rejected or delayed, KOCCA will notify the applicant.
Article 5 (Changes to Registration Information)
Members must update their information if any registered details change.
Article 6 (Sharing of Member Information)
1. Member information may be shared in cases of business partnerships, mergers, or restructuring for service enhancement.
2. Information may also be shared with sponsors for prize fulfillment in events.
3. KOCCA will notify users when such sharing occurs.
Article 7 (Use of Additional Member Information)
Additional user information may be used only for administrative or statistical purposes.
Article 8 (Provision of Information)
KOCCA may send users information about events or services via email or postal mail.
Article 9 (Personal Information Protection)
1. KOCCA will obtain user consent before collecting personal data.
2. KOCCA is fully responsible for any damages resulting from unauthorized use, loss, or leakage of personal data, except in cases permitted under Article 6.
Chapter 3: Use of Services
Article 1 (Availability of Services)
Services are available 24/7 unless operational or technical disruptions occur. Scheduled maintenance may result in temporary suspension with prior notice.
Article 2 (Service Suspension)
KOCCA may suspend services in the following cases:
1. System maintenance or unavoidable circumstances
2. Disruption by third-party telecommunications providers
3. Other operational or legal limitations
Article 3 (Data Deletion and Account Restrictions)
1. KOCCA may delete user data if system storage is limited.
2. KOCCA may inspect or restrict user accounts without notice if security or operational risks arise.
3. In such cases, users will be notified in advance when possible.
Chapter 4: Restrictions and Termination
Article 1 (Restrictions on Use)
The following behaviors may result in service suspension or account termination:
1. Unauthorized use of another member’s ID
2. Criminal activity or intent
3. Disruption of public order or morality
4. Defamation or harassment
5. Intellectual property infringement
6. Hacking or distribution of malicious software
7. Sending spam or unsolicited content
8. Actions threatening system stability
9. Violations of applicable laws
Article 2 (Termination of Agreement)
1. To terminate the agreement, users must submit a request at least one day in advance (two days for public holidays).
2. KOCCA may terminate the agreement if a violation is not resolved within the designated period.
3. Users whose accounts are terminated may be restricted from re-registering for a certain period.
Chapter 5: Responsibilities
Article 1 (Member Responsibilities)
1. Members are responsible for managing their ID and password.
2. IDs and passwords may not be transferred or shared without permission.
3. Unauthorized use must be reported to KOCCA immediately.
4. Members must update any changes to their personal information.
5. Members must comply with all applicable laws and these Terms.
Article 2 (KOCCA’s Responsibilities)
1. KOCCA will provide access to services as agreed, except in cases described in Chapter 3.
2. KOCCA will provide services consistently and reliably but is not liable for unavoidable data loss.
3. KOCCA will not disclose personal data to third parties without consent, except when required by law.
4. KOCCA will address user complaints promptly or notify the user of delays.
Article 3 (Content Deletion)
KOCCA may delete user-generated content without notice if it violates the Terms or exceeds designated time limits.
Chapter 6: Liability and Disclaimers
Article 1 (Limitation of Liability)
KOCCA is not responsible for any user damages unless caused by its gross negligence or willful misconduct.
Article 2 (Disclaimers)
1. KOCCA is not liable for service disruption due to force majeure.
2. KOCCA is not responsible for issues caused by user negligence.
3. KOCCA does not guarantee any expected outcomes from service use.
4. KOCCA is not liable for the accuracy or reliability of user-generated content.
5. Users are fully responsible for managing their login credentials.
6. Users who violate these Terms and cause harm to KOCCA or third parties shall be liable for all resulting damages.
Chapter 7: Use of Community Services
Article 1 (Restrictions on Use)
The following actions are prohibited in KOCCA’s community spaces:
1. Violating others’ privacy or legal rights
2. Posting defamatory, obscene, or illegal content
3. Uploading copyrighted materials without permission
4. Distributing viruses or malicious code
5. Posting unsolicited advertisements or promotions
6. Conducting pyramid schemes or chain letters
7. Downloading unauthorized or non-shareable files
8. Removing copyright notices or watermarks
9. Disrupting other users’ participation
10. Posting inappropriate content related to religion, politics, or hate speech
KOCCA reserves the right to terminate or restrict access without notice.
Article 2 (KOCCA’s Role)
1. KOCCA is not obligated to monitor community activity but may remove content or disclose information to comply with legal requirements.
2. All community activity is public, not private. Users should exercise caution when posting personal or identifying information.
3. KOCCA disclaims all responsibility for disputes or issues arising within community forums.
Chapter 8: Miscellaneous
Article 1 (Amendments to the Terms)
KOCCA will provide notice at least 7 days in advance for changes to the Terms, and 30 days in advance for any changes that may negatively affect users.
Article 2 (Dispute Resolution)
1. KOCCA and users shall make all efforts to resolve disputes amicably.
2. If a dispute leads to legal action, the case shall be submitted to the court of jurisdiction under Korean civil law.
